These Terms govern your use of Farmark, a family calendar and household display service. Please read them carefully.
1. Agreement To These Terms
By creating an account, starting a trial, connecting a calendar, using Farmark, or accessing our website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Farmark.
2. The Service
Farmark helps families organize calendars, reminders, widgets, and household display screens. Features may include manual events, connected calendars, reminders, weather, family widgets, smart summaries, display pairing, and related account tools.
Farmark is an organization and display tool. It is not an emergency alert system, medical service, legal service, child safety monitoring service, home security system, or substitute for direct parental, caregiver, or household supervision.
3. Eligibility And Accounts
You must be at least 18 years old, or the age of majority where you live, to create a Farmark account. Farmark is intended to be managed by a parent, guardian, or adult household administrator.
You are responsible for your account credentials, display pairing credentials, household users, connected calendars, and activity under your account. Keep your password and paired display access secure.
4. Household Administrators And Family Data
The person who creates or manages a Farmark family account is responsible for deciding what household information is added, who can see it, and which calendars or devices are connected. You represent that you have the rights and permissions needed to add family information, calendar feeds, and connected accounts to Farmark.
5. Calendar Integrations
When you connect iCal, ICS, or supported Google calendars, you authorize Farmark to access, store, process, sync, and display calendar data as described in the Privacy Policy and as needed to provide Farmark features.
Calendar imports are read-only unless a feature clearly says otherwise and asks for additional permission. Calendar provider outages, permissions, rate limits, changed events, shared calendar settings, or revoked access may affect sync accuracy.
iCal, ICS, and Google Calendar sources can be removed from Farmark settings. You can also revoke Google access through your Google account security settings.
6. Subscriptions, Trials, And Billing
Farmark may offer free trials, monthly subscriptions, annual subscriptions, promotional access, or beta access. Prices, billing periods, renewal terms, and included features appear at checkout or inside the service.
Unless checkout or applicable law says otherwise, paid subscriptions renew automatically until canceled. You authorize Farmark and its payment processor to charge the payment method on file for recurring fees, taxes, and permitted charges.
Payments are processed by a third-party payment processor such as Stripe. Farmark does not store full payment card numbers.
7. Cancellations And Refunds
You may cancel a paid subscription through Farmark billing tools or by contacting [email protected]. Cancellation stops renewal charges but does not automatically refund past charges.
If your subscription is canceled, expired, or past due, Farmark may provide a way to reactivate through Stripe or Farmark account settings while the account data is still retained under the Privacy Policy.
Unless required by law or stated at checkout, fees are non-refundable and partial billing periods are not prorated. If something goes wrong, contact us. We can review refund requests case by case, especially for accidental charges, duplicate billing, or a clear service failure.
8. Acceptable Use
You agree not to:
- use Farmark for unlawful, harmful, abusive, harassing, deceptive, or invasive activity;
- attempt to access another family's account, calendars, display devices, or data;
- interfere with Farmark's systems, security controls, authentication, or rate limits;
- upload malware, exploit code, or content that violates others' rights;
- resell, scrape, reverse engineer, or abuse Farmark except where law allows;
- connect calendar feeds, accounts, or data you are not authorized to access or share;
- use Farmark to make emergency, safety-critical, medical, legal, or financial decisions without independent confirmation.
9. Your Content
You retain ownership of calendars, reminders, labels, settings, family information, and other content you add to Farmark. You grant Farmark a limited license to host, process, transmit, display, back up, and secure that content solely to provide, maintain, protect, support, and improve the service.
You are responsible for the accuracy and legality of the content you add or connect.
10. Farmark Intellectual Property
Farmark, including its software, design, branding, website, text, graphics, and related materials, is owned by Farmark or its licensors. These Terms do not grant you ownership of Farmark intellectual property.
11. Third-Party Services
Farmark may depend on third-party services such as calendar providers, payment processors, hosting providers, email providers, app stores or browsers, analytics, and display hardware. Farmark is not responsible for third-party services, their availability, their terms, or changes they make to their services.
12. Service Changes And Availability
We may add, change, limit, suspend, or discontinue features as we improve Farmark. We aim for a reliable service, but we do not guarantee uninterrupted, timely, secure, or error-free operation. Internet outages, calendar provider changes, device settings, browser behavior, and third-party services may affect availability.
13. Suspension And Termination
You may stop using Farmark or cancel your subscription at any time. We may suspend or terminate access if you violate these Terms, fail to pay fees, create risk for other users or Farmark, use the service abusively, or if required by law.
After termination, cancellation, or expiration, we may retain or delete data as described in the Privacy Policy and as permitted or required by law. Farmark generally keeps app account data for at least 30 days for reactivation and may delete or anonymize inactive account data after 90 days.
14. Disclaimers
Farmark is provided on an "as is" and "as available" basis. To the fullest extent allowed by law, Farmark disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, title, uninterrupted operation, and error-free performance.
Farmark does not guarantee that calendar data will always be complete, current, synchronized, or displayed exactly as it appears in a third-party calendar service. You should independently confirm important appointments, deadlines, travel, medical, school, legal, or safety-related information.
15. Limitation Of Liability
To the fullest extent allowed by law, Farmark will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, calendar provider outages, missed appointments, missed reminders, household decisions, or device/display failures.
To the fullest extent allowed by law, Farmark's total liability for claims related to Farmark will not exceed the greater of $100 or the amount you paid to Farmark in the twelve months before the event giving rise to the claim.
16. Indemnification
You agree to defend, indemnify, and hold harmless Farmark from claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your use of Farmark, your content, your connected calendars, your violation of these Terms, or your violation of someone else's rights.
17. Governing Law
These Terms are governed by applicable law, without regard to conflict of law rules. The required venue for disputes will be determined by applicable law.
18. Changes To These Terms
We may update these Terms as Farmark changes. If changes are material, we will provide notice through the service, by email, or by posting updated Terms with a new effective date. Continued use of Farmark after the effective date means you accept the updated Terms.
